General terms and conditions

This website is operated by and displays products provided by Salzburg Panorama Tours GmbH. 
Salzburg Panorama Tours GmbH organises sightseeing tours and transfers and provides additional services within the legal framework of a private car hire company.
Panorama Tours & Travel GmbH acts solely as an intermediary agent and is not the operator of these tourism offers.
Contracts are concluded solely based on these general terms and conditions. Any contradictory general terms and conditions from corporate clients shall be expressly excluded. The provisions shall only apply to consumers insofar as they do not contradict the mandatory consumer protection provisions.

The following conditions apply for both Salzburg Panorama Tours GmbH and Panorama Tours & Travel GmbH, unless stated otherwise.


1.1. General conditions of travel

The general conditions of travel apply in the respective valid version. We would like to inform our customers of the following conditions that are applicable to their booking and are supplementary to the general conditions of travel set out in the Austrian Travel Contract Law (Reisevertragsgesetz).
 
1. These conditions apply to all bookings made via the Panorama Tours & Travel GmbH website at www.panoramatours.com . All correspondence shall be addressed to Salzburg Panorama Tours GmbH or Panorama Tours & Travel GmbH, Schrannengasse 2/2, 5020 Salzburg, Austria. By making a booking, you accept these booking conditions on behalf of all parties included in the booking.
 
2. Each booking or order is an offer made by the customer to purchase the respective services of the service provider under these booking conditions. No contractual agreement exists between you and Salzburg Panorama Tours GmbH or Panorama Tours & Travel GmbH until such a time as
 
•    a. you have been provided with a booking reference  number, and
•    b. the booking has been confirmed by email, and
•    c. you have paid for the booking in full.
 
3. The total price of the service is due at the time of booking. The payment shall be made via the Salzburg Panorama Tours GmbH website by credit card or bank transfer using the “Sofort” banking system. You assume full financial responsibility for all your transactions carried out through Salzburg Panorama Tours GmbH or Panorama Tours & Travel GmbH. This includes all room fees, taxes, additional fees and charges incurred in connection with the booking.
If Panorama Tours & Travel GmbH cannot confirm the original supplier, they shall be entitled to suggest an alternative supplier and they shall inform the customer of the particulars via email.
The reservation shall be held for 48 hours in order to give you the opportunity to accept the offer by making a payment of the full amount. The reservation will be automatically cancelled if no payment is made within 48 hours of the notification.
 
4. Bookings and changes to existing bookings can only be accepted up to 72 hours before arrival with the exception of items with immediate confirmation.
A star system is used to categorise the overall quality of the hotel, standards of service, the quality of the food and other services the hotel offers. The criteria used for the classification may differ slightly from country to country as the requirements to be fulfilled are stipulated by the relevant local authorities. The guidelines below give an idea as to what may be expected in the individual categories (THESE CLASSICATIONS ARE SOLELY FOR INFORMATIONAL PURPOSES AND DO NOT REPRESENT A GUARANTEE OR ASSURANCE ON BEHALF OF PANORAMA TOURS & TRAVEL GMBH).
 
5. Panorama Tours & Travel GmbH classifies room types as follows:
 
Twin room
Accommodation for two adults in one room with two beds. These rooms are often equipped with twin beds or one full bed in European hotels.
 
Double room
Accommodation for two adults in one room with one bed. These rooms are often equipped with one queen-size bed in European hotels.
 
Single room
Accommodation for one adult in one room with one bed. These rooms are often equipped with twin beds or one full bed in European hotels.
 
Triple room
Accommodation for three adults in one room with two or three beds. These rooms are often a twin room equipped with three beds in European hotels.
 
Double room for single use
Accommodation for one adult in one room with one bed. These rooms are often equipped with one queen-size bed in European hotels.
 
Quad room
Accommodation for four adults in one room with two or four beds. These rooms are often a twin room equipped with four beds in European hotels.
 
Twin/double room + child
A twin or double room with an extra bed suitable for child aged 2-18 years.
 
Extra bed/cot or cradle
Suitable for children under 2 years of age
 
The cost of any extras (incidental expenses, meals, supplements for meals, minibar costs, cleaning and laundry services) shall be borne by you and paid in full on departure from the hotel.
 
6. Panorama Tours & Travel GmbH neither recommends nor endorses any specific hotels. We endeavour to keep the information on this site up-to-date but reserve the right to make changes at any time and without prior notice. All information published on this website is provided in good faith. PLEASE NOTE THAT PANORAMA TOURS & TRAVEL GMBH IS THE BOOKING AGENT AND CANNOT CHECK ALL THE INFORMATION PROVIDED BY THE HOTELS AND ASSUMES NO RESPONSIBILITY FOR THIS. Panorama Tours & Travel GmbH does not have access to the room availability for the hotels. If the hotel has no rooms available for immediate booking through Panorama Tours & Travel GmbH, then it is likely that our room quota for the contractually agreed price has been exhausted.
 
7. You affirm that you are at least 18 years of age. All bookings are for you personally and cannot be re-sold, transferred or otherwise passed on to others.
 
8. It is your responsibility to ensure that the passport, visa and health care provisions for yourself and your travel group are correct. We recommend that you take out travel cancellation insurance and medical insurance.
 
9. Cancellations and amendments after the booking has been confirmed may only be made under the following conditions.
A withdrawal period of 24 hours applies to bookings (hereinafter not explicitly mentioned) that are made at least 72 hours before the date of arrival. This means that cancellations and amendments made to the booking within the 24-hour period after the first booking confirmation can be made free of charge.
 
The withdrawal period of 24 hours after the first booking confirmation does not apply to bookings made for periods when special events are taking place:
•    a. During time periods with special events 
CUSTOMERS SHALL BE INFORMED WHEN BOOKING IF A SPECIAL EVENT IS TAKING PLACE DURING THE TIME PERIOD TO BE BOOKED AND IF SPECIAL BOOKING CONDITIONS APPLY
Stays booked for the period during which special events are taking place are subject to a cancellation fee of 100%. Our standard cancellation and amendment provisions apply to any days within the same booking that do not fall within the special event period. 
Any amendments or changes made to dates that fall during a special event period shall be treated as cancellations and are subject to the above-mentioned cancellation fee. These fees do not apply to the addition of additional rooms/beds/nights to rooms or stays that have already been booked or confirmed.
•    b. Outside of time periods with special events
EACH HOTEL on the booking charges a cancellation fee proportional to the period of time remaining between the date of the cancellation notification and the dates of the stay. 
Amendments that reduce EITHER the number of rooms (regardless of the room type) OR the number of nights are subject to the following fees:

Amendments

72 hours or more before arrival: a)  EUR 12.00 or b)  the cost of the first night (the lower of the two amounts)

Changes to the name of the traveller or the age of children will be made free of charge. Amendments may only be made subject to availability. 

If you fail to arrive at your accommodation on the arrival date booked, or you depart at an earlier date, your cancellation or amendment is only valid from the time at which you inform Panorama Tours & Travel GmbH of your intentions. This notification may only take place during the business hours of Panorama Tours & Travel GmbH. All cancellations or amendments of this nature are made on the understanding that you will cover the accommodation costs for the 24 hours following your notification to Panorama Tours & Travel GmbH.

Cancellations made directly at the hotel are invalid. All cancellation or amendment requests must be made via the website at www.panoramatours.com. All refund requests must include the relevant receipts and supporting documents and be made in writing and arrive at our offices no later than 30 days after your return from your stay.

Other travel arrangements
i. Sightseeing tours

Special conditions
If special booking conditions apply to certain tours, you will be informed at the time of booking of the applicable cancellation policy. 

For tours with no special cancellation policy, the cancellation fees charged shall be based on the period of time between the notification of cancellation and the start of the service booked.

Cancellations - Fees
0-48 hours before the start of the service booked: 100% of the price
More than 48 hours before the start of the service booked: EUR 20.00

ii. Transfers and custom sightseeing tours

If you are travelling with babies and small children, it is your responsibility to ensure that you bring with you and install an appropriate child car seat in the vehicle booked. Failure to do so may result in the inability to provide the service and you will not be entitled to a refund in this case.

Special conditions
If special booking conditions apply to certain tours, you will be informed at the time of booking of the applicable cancellation policy. 

For tours with no special cancellation policy, the cancellation fees charged shall be based on the period of time between the notification of cancellation and the start of the service booked.

Cancellations and amendments - Fees
0-96 hours before the start of the service booked: 100% of the price
More than 96 hours before the start of the service booked: EUR 20.00

In the case of amendments, 100% of the price will only be charged if the number of customers decreases.

Important information for sightseeing tours
Tips are not included and are at your discretion.

Children, who travel free-of-charge, are not entitled to catering and must be seated on the lap of the accompanying adult if there are not enough seats available for them to have their own.

The suppliers of sightseeing tours reserve the right to exclude individuals from the tour if their actions or behaviour is offensive or disruptive to other passengers. Any further claims are excluded in this case.

The suppliers of sightseeing tours accept no liability for the loss of items that have been forgotten in vehicles or lost.

The information on hotel pick-up times and the duration of tours is only an approximation and may differ due to traffic conditions.

In the case of tours offering a hotel pick-up service: This service is available for the majority of the most important hotels in the city, but not for every hotel.

If the supplier cannot pick you up at your hotel, they shall suggest an alternative pick-up point.

The suppliers of sightseeing tours reserve the right to alter the itinerary or cancel tours at short notice and without notice.

If a tour has to be cancelled, then you will be offered at least one of the following options:

1. Take the tour at another time or on another date.
2. Take another tour.
3. Receive a full refund from Panorama Tours & Travel GmbH.
  
10. Complaints and third-party suppliers
Any complaints regarding the hotel should be made to the hotel management as soon as possible during your stay and no later than one (1) day after you become aware of the subject of the complaint. If a satisfactory solution cannot be found, then please inform Panorama Tours & Travel GmbH in writing.
 
Although Panorama Tours & Travel GmbH takes reasonable steps to ensure that the descriptions published are correct, please note that this is only a booking service and Panorama Tours & Travel GmbH does not own or operate the hotels. PANORAMA TOURS & TRAVEL GMBH ASSUMES NO LIABILITY FOR ERRORS OR OMISSIONS IN THE HOTEL DESCRIPTIONS ON THIRD-PARTY WEBSITES. Panorama Tours & Travel GmbH reserves the right to change your hotel booking to a booking of at least comparable quality and you will be informed of any changes as soon as possible after they have been made. This right shall only apply to consumers insofar as it does not contradict the mandatory consumer protection provisions. No compensation for damages, with the exclusion of personal injury, will be provided in the case of changes due to slight negligence. In extreme cases, Panorama Tours & Travel GmbH may be forced to cancel your booking. In this case, you will be informed as soon as possible, and an immediate refund will be issued. Panorama Tours & Travel GmbH assumes no further liability towards you or your travel group. Panorama Tours & Travel GmbH shall make every effort to ensure that any discount vouchers issued may be redeemed at any time. However, we grant our supplier partners the right to change the conditions of the voucher or to withdraw the voucher at any time and without prior notice. This is a rare occurrence. However, please note that the voucher should be valid but that this cannot be guaranteed.
 
Panorama Tours & Travel GmbH assumes no responsibility for delays or the non-provision of services due to circumstances or causes beyond the control of the Panorama Tours & Travel GmbH. Without placing limitations on the above statement, the following are understood to be the above-mentioned circumstances: Force majeure, outbreak of hostilities, riots, civil unrest, terrorism, revolutions, acts of government or authorities (including, but not limited to, the refusal or withdrawal of licenses or permits), fire, floods, storms, explosions, fog or bad weather, disease, looting, machine damage, interruptions or failure of supplies (including, but not limited to, electricity, gas, water and telecommunications), renovations at the hotel, strikes, lock-outs or boycotts, embargoes, and blockades.
 
Salzburg Panorama Tours GmbH and Panorama Tours & Travel GmbH assume no liability for damage or damage by viruses to your computer equipment or other property that arise due to the use or viewing of this website or the download of materials, data, text, images, videos or video recordings from the website. NEITHER SALZBURG PANORAMA TOURS GMBH AND PANORAMA TOURS & TRAVEL GMBH NOR A THIRD-PARTY PROVIDER OR SUPPLIER ASSUMES RESPONSIBILITY FOR INJURIES, LOSSES, CLAIMS, DAMAGES OR OTHER PUNITIVE, INDIRECT, INCIDENTAL OR CONSEEQUENTIAL DAMAGES OR THOSE SUBJECT TO A FINE (INCLUDING, BUT NOT LIMITED TO, LOSS OF REVENUE OR SAVINGS) – REGARDLESS OF ANY CONTRACTUAL PROVISIONS FOR TORT, STRICT LIABILITY OR OTHERWISE – THAT ARISE FROM OR ARE CONNECTED WITH (1) THE USE OF THIS WEBSITE OR ITS CONTENT, (2) MISTAKES OR DELAYS INCLUDING, BUT NOT LIMITED TO, THE USE OR NON-USABILITY OF PARTS OF THIS WEBSITE FOR MAKING BOOKINGS OR ISSUING TICKETS, OR (3) SERVICES OR ERRORS ON THE PART OF PANORAMA TOURS & TRAVEL GMBH OR A THIRD PARTY PROVIDER OR SUPPLIER. PANORAMA TOURS & TRAVEL GMBH ASSUMES NO LIABILITY FOR EXPRESS AND IMPLIED GUARANTEES, INCLUDING SALEABILITY AND SUITABILITY FOR A SPECIFIC PURPOSE.
 
PANORAMA TOURS & TRAVEL GMBH ASSUMES NO RESPONSIBILITY FOR INJURIES, DAMAGES, LOSSES, ACCIDENTS, EXPENDITURE, DELAYS OR IRREGULARITIES ARISING FROM THE ACTIONS OR NON-PERFORMANCE OF A HOTEL, TRANSPORTER, COMPANY OR PERSON WHO PROVIDES THE SERVICES INCLUDED IN THE BOOKING.
 
You agree that the liability of Panorama Tours & Travel GmbH shall be limited to the higher of the following amounts in the event of claim for compensation:
(a) EUR 1000.00 or
(b) double the value of the original booking made with Panorama Tours & Travel GmbH.

This right shall only apply to consumers insofar as it does not contradict the mandatory consumer protection provisions.

Should Panorama Tours & Travel GmbH initiate legal proceedings against you to enforce the rights of the company afforded to them in these booking conditions, then the company shall be entitled to claim all necessary and reasonable legal and litigation fees from you and you affirm that you are ready to pay these fees. This includes all legal and fair additional compensation for which Panorama Tours & Travel GmbH may be eligible. The place of jurisdiction is Salzburg, Austria.

Panorama Tours & Travel GmbH reserves the right to change these terms and conditions from time to time.
 
11. Liability of the tour operator
 
The operator shall exercise the due diligence of a good businessman to
•    be conscientious in making travel arrangements,
•    carefully select and monitor service providers,
•    check the accuracy of all the travel services descriptions in this brochure, insofar as the tour operator did not declare a change in information for the brochure before the contract was concluded in accordance with section 3,
•    and ensure the proper provision of the agreed travel services.
 
The operator assumes liability for any faults pertaining to the person entrusted with providing the service. If travel on a scheduled service is included in a journey or is included in addition to this and a corresponding ticket is issued, then this service is provided by an external provider. We do not assume liability for the provision of this service. The assumption of liability in this event is on the part of the company providing the service.
 
12. Legal basis in the case of service disruption
 
12.1 Guarantee
The customer has a legal guarantee claim in the case of non-provision or inadequate services. The customer agrees that instead of annulling the contract or requesting a reduction in price, the operator may provide an adequate service or improve the inadequate service within a reasonable period of time.
This may be remedied in such a way so that any deficiencies are fixed, or an equal or higher quality replacement service is performed with the express consent of the customer. It is therefore necessary that the service provider is informed immediately or the operator is contacted to remedy the situation.
 
12.2 Compensation for damages
If the obligations arising from the contractual relationship culpably infringe the operator or their assistants, then the customer is obligated to compensate them for the damages arising from this.
Insofar as the tour operator is liable for persons other than their employees, they shall only be liable in the event that they cannot prove that the damages were not incurred intentionally or due to gross negligence.
The tour operator assumes no liability, provided there are no personal injuries, for items that are not normally carried unless they knowingly took such items into safekeeping. Therefore, we recommend that customers take their valuables with them. We also recommend that they store items in a proper manner.
The customer shall endeavour to keep damages to a minimum. In particular, this means that they should report any complaints and claims immediately. If the customer fails to do so, this diminishes or annuls their entitlement to compensation for all other damages that would not have been incurred if the customer had made the report in a timely manner.
 
13 Notification of defects

The customer shall notify the operator immediately of any defects. If the customer fails to notify the operator, they may be credited with contributory negligence and their claims for damages reduced. Any guarantee claims are not affected. A written affidavit from the person who received the complaint is useful in order to process any claims e.g. due to loss. The traveller's claims only become valid if they are not deemed to be at fault.
 
14 Assertion of claims
 
We recommend that customers write a written confirmation incl. any evidence, statements or witnesses of the non-provision or inadequate service in order to facilitate the assertion of claims. In the interest of the traveller, we recommend that claims are made immediately upon their return from the trip and directly to the organiser or via an intermediary travel agency as increasing delays and difficulties gathering evidence are to be expected.
 
15 Guarantee
 
The statutory guarantee periods apply.
 
16 Invalidity of individual provisions
 
The invalidity of individual provisions in the travel agreement do not affect the validity of the travel agreement as a whole.
 
17 Dispute resolution

The EU has an online dispute resolution platform (ec.europa.eu/odr). Panorama Tours & Travel GmbH decides on their participation in dispute resolution on a case-by-case basis. If you have any questions regarding dispute resolution, please contact Mag. Stefan Herzl at office@panoramatours.com.
 
18 Applicable law and place of jurisdiction
 
Austrian law applies exclusively to contracts not concluded with customers and to the exclusion of the rules regarding the conflict of laws. The place of jurisdiction is the relevant competent court for the city of Salzburg, Austria. The place of performance is 5020 Salzburg, Austria.
 
19  Price changes and corrections
 
We reserve the right to make price changes up until the time of booking at your travel agency. We reserve the right to correct printing errors and obvious calculation errors without notification. All information subject to change without notice.
 
20 Passport, visa and health requirements
 
It is assumed that a valid passport is required for travel abroad. The operator will inform the customer of the respective additional passport, visa and health requirements and, on request, provide information on foreign currencies and customs regulations insofar as this can be obtained in Austria. The customer is responsible for compliance with these regulations.
 
21 Travel agency regulation (safeguarding customers’ funds in accordance with the EU directive)
 
The registration number for Panorama Tours & Travel GmbH is 1998/0285. The company is registered in the organiser's directory with the BmfwA (Bundesministerium für Wirtschaft und Arbeit - Federal Ministry of Economics and Work) and is part of an insurance pool in accordance with the provisions in § 9 para. 6 of the RSV (Reisebüro-Sicherungs-Verordnung - Travel Agency Regulation)
In the case of insolvency, all claims for loss of claims must be made to Europäischen Reiseversicherung AG within eight (8) weeks of the insolvency occurring.
